- You are not barred from using the Service under applicable laws
2. Service Description
Collabeauty enables content creators on TikTok and Instagram to discover and participate in brand campaigns. Users must be at least 18 years old and provide accurate information when registering or connecting accounts.
3. Account & Data Usage
TikTok Account Connection
When you connect your TikTok account, you authorize us to access information through TikTok Login Kit, including:
- open_id, display_name
- username, is_verified, profile_deep_link
- follower_count, likes_count, video_count
- video metadata (e.g., views, likes, shares)
This data is used to verify creators, assess influence, and support campaign matching and analysis.
Instagram (Meta) Account Connection
When you connect your Instagram account, you authorize us to access information through Meta Graph API, including:
- Account information (username, account type, media count)
- Media data (posts, reels, insights)
- Engagement metrics (likes, comments, saves)
- Profile information (biography, website, follower count)
By connecting your Instagram account, you confirm that:
- You own or have proper authorization to grant us access to this account
- You understand Meta's Platform Terms and Developer Policies
- You consent to our use of this data as described in our Privacy Policy
- You can revoke access at any time through your Instagram settings or our platform
We access and use this data in compliance with Meta Platform Terms.
Facebook App Integration
Our service includes Facebook App ID (fb:app_id) integration to:
- Enable seamless social media integration and sharing
- Provide proper app identification for Meta platform interactions
- Ensure compliance with Meta's technical requirements
- Support social plugins and Meta platform features
By using our service, you acknowledge that the Facebook App ID is publicly accessible in our website metadata as required by Meta's platform policies. This identifier enables secure communication between our platform and Meta services but does not access personal data independently.
4. Prohibited Conduct
Users agree not to misuse the Service, submit false information, or engage in any actions that disrupt platform functionality. We reserve the right to suspend or terminate access for violations.
When connecting social media accounts, users must not:
- Provide access to accounts they don't own or have authorization to use
- Use the platform to scrape or collect data in violation of platform terms
- Attempt to manipulate engagement metrics or follower counts
- Misrepresent their identity or account ownership
Campaign Violations and Fraudulent Activity
Users who engage in the following activities will be subject to account suspension or permanent ban:
- Failing to upload agreed-upon sponsored content after accepting a campaign and receiving payment
- Uploading content that does not meet the agreed campaign requirements or brand guidelines
- Deleting sponsored content before the agreed minimum posting period
- Providing false analytics or engagement data to the platform or brands
- Attempting to deceive the platform or brand partners regarding content delivery
- Using fraudulent methods to inflate engagement metrics or follower counts
- Accepting campaign payment without intention to fulfill obligations
Such violations constitute fraud and breach of contract. In addition to account termination, we reserve the right to:
- Demand refund of all payments received for unfulfilled campaigns
- Report fraudulent activity to relevant authorities
- Share information about violations with brand partners and industry networks
- Pursue legal action for damages incurred
Account Bans and Restrictions
If your connected social media accounts (Instagram or TikTok) are banned or restricted by the respective platforms:
- You will be immediately notified via email and in-app notification
- Your access to our Service may be restricted or terminated
- You must resolve the ban with the respective platform before regaining access
- We are not responsible for account bans imposed by third-party platforms
We monitor the status of connected accounts to ensure compliance with platform policies. If we detect that:
- Your Instagram or TikTok account has been banned or suspended
- You are in violation of Instagram, TikTok, or Meta platform terms
- Your account shows signs of fraudulent or automated behavior
We may immediately suspend your access to our Service to maintain platform integrity and compliance with our third-party partners.
5. Service Limitations & Disclaimers
Service Availability
While we strive to provide uninterrupted service, we do not guarantee that the Service will be available at all times. We may suspend or discontinue the Service:
- For scheduled maintenance or updates
- Due to technical issues beyond our control
- In response to legal requirements or threats
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Accuracy or reliability of campaign results
- Uninterrupted or error-free operation
Limitation of Liability
To the maximum extent permitted by law, Collabeauty shall not be liable for:
- Any indirect, incidental, or consequential damages
- Lost profits or business opportunities
- Data loss or corruption
- Damages exceeding the amounts paid by you for the Service
6. Account Suspension & Termination
Grounds for Suspension or Termination
We may suspend or terminate your account if:
- You violate these Terms or our policies
- You engage in fraudulent or illegal activities
- You provide false or misleading information
- Your account shows signs of automated or suspicious behavior
- Your connected Instagram or TikTok account has been banned or suspended by the respective platform
- You violate third-party platform terms (Meta, TikTok, etc.)
- You fail to deliver agreed-upon sponsored content after accepting a campaign
- You attempt to deceive the platform or brand partners
- You provide fraudulent analytics or engagement data
Social Media Account Bans
If your connected social media account (Instagram or TikTok) is banned or restricted:
- You will receive email notification informing you of the ban detection
- Your access to our Service will be automatically suspended
- A modal notification will appear upon login explaining the restriction
- You must resolve the ban with the respective platform to regain access
- We reserve the right to permanently terminate accounts with repeated violations
We monitor connected accounts to detect bans imposed by Instagram and TikTok. This is necessary to:
- Maintain compliance with third-party platform policies
- Protect our platform's reputation and standing with partners
- Ensure campaign quality for brand partners
- Prevent fraudulent or policy-violating activities
Effects of Termination
Upon termination:
- Your access to the Service will be immediately revoked
- Ongoing campaigns may be cancelled
- You may lose access to your account data
- You remain liable for any outstanding obligations
- Connected social media accounts will be disconnected from our platform
Appeal Process
If you believe your account was wrongfully terminated, you may appeal the decision by:
- Contacting our support team at contact@collabeauty.net
- Providing relevant evidence supporting your appeal
- Demonstrating that your social media accounts are in good standing
We will review appeals within 5-7 business days. The decision to reinstate an account is at our sole discretion.
7. Invoices for Brand Partners
For campaigns involving paid collaborations, Collabeauty automatically generates and provides invoices on behalf of creators to participating brand partners. These invoices include essential information such as creator name, service description, campaign fee, and bank account details. Brands agree to receive such invoices electronically through the platform as part of their campaign participation.
8. Third-Party Platform Compliance
Our service integrates with third-party platforms including Meta (Instagram), TikTok, and Google. Your use of these integrations is subject to each platform's respective terms:
We strive to maintain compliance with all platform policies, but users are responsible for understanding how their use of our service interacts with their obligations to these third-party platforms.

10. Dispute Resolution
Informal Resolution
Before pursuing formal legal action, users agree to:

- Attempt good-faith negotiation

Governing Law
These Terms are governed by and construed in accordance with the laws of South Korea. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Korea.
Legal Fees
In any legal action related to these Terms, the prevailing party shall be entitled to recover reasonable attorney's fees and legal costs.
